Information on Ohio Law Regarding: State or Political Subdivision Funds for Non-therapeutic Abortion Benefits
Ohio employer law (HB 153) prohibits the use of, not only state funds, but also political subdivision1 funds to pay for any health care policy that provides for any coverage, benefits or services related to a non-therapeutic abortion. The law does allow for non-therapeutic abortion coverage on an individual basis through which an individual may obtain coverage of a non-therapeutic abortion if the individual pays for all the associated costs, premiums or, charges.
As defined by Ohio law, a non-therapeutic abortion means any abortion that is performed or induced when a life of a mother would not be endangered if the fetus were carried to term, or when the pregnancy was not a result of rape or incest reported to law enforcement.

*As defined by Ohio, "political subdivision" means any body, corporate and politic, that is responsible for governmental activities in a geographic area smaller than the Am. Sub. H. B. No. 153 129th G.A.21 state, except that "political subdivision" does not include either of the following: (a) A municipal corporation; or (b) A county that has adopted a charter under Section 3 of Article X, Ohio Constitution, to the extent that it is exercising the powers of local self-government as provided in that charter and is subject to Section 3 of Article XVIII, Ohio Constitution.
"State" has the same meaning as in section 2744.01 of the Revised Code, which means the state of Ohio, including the General Assembly, the Supreme Court, the offices of all elected state officers, and all departments, boards, offices, commissions, agencies, colleges and universities, institutions, and other instrumentalities of the state of Ohio. "State" does not include political subdivisions.
